O Chartered Institute of Arbitrators (Ciarb) Brazil Branch convida para a primeira reunião de trabalho de 2026, dedicada ao tema provas documentais, dando continuidade à iniciativa que culminou, em 2025, no lançamento do Guia Ciarb Brazil sobre depoimento escrito de testemunha de fato. Para este ano, a produção de documentos foi escolhida como eixo central dos eventos acadêmicos do Branch.
A reunião inaugural terá como foco o sistema de produção de documentos previsto no artigo 3 das International Bar Association Rules on the Taking of Evidence in International Arbitration, abordando seu funcionamento, requisitos, poderes do tribunal arbitral, consequências da não apresentação de documentos e os desafios relacionados a documentos em posse de terceiros não signatários da convenção de arbitragem.
O encontro será realizado em 13 de março de 2026, das 9h30 às 12h, no CIESP/FIESP (Avenida Paulista, 1.313), em formato mesa redonda, incentivando a participação ativa de todos os presentes. A reunião seguirá a Chatham House Rule, com registro anonimizado das contribuições.
A moderação será de Bernard Potsch, FCIArb, Vice-Diretor de Educação do Ciarb Brazil Branch, e contará com as contribuições de Emily C. Westphalen, Karina Goldberg e Marcela Kohlbach.
A iniciativa integra a agenda acadêmica do Branch, sob a Presidência de Cristina M. Wagner Mastrobuono e coordenação de Educação de Lucas V. R. da Costa Mendes e Bernard Potsch.

The Chartered Institute of Arbitrators (Ciarb) Brazil Branch invites you to the first working meeting of 2026, dedicated to the topic of documentary evidence, continuing the initiative that culminated in 2025 with the launch of the Ciarb Brazil Guide on written testimony from factual witnesses. For this year, the production of documents has been chosen as the central theme of the Branch’s academic events.
The inaugural meeting will focus on the document production system provided for in Article 3 of the International Bar Association Rules on the Taking of Evidence in International Arbitration, addressing its operation, requirements, powers of the arbitral tribunal, consequences of failure to produce documents, and challenges related to documents in the possession of third parties who are not signatories to the arbitration agreement.
The meeting will be held on March 13, 2026, from 9:30 a.m. to 12 p.m., at CIESP/FIESP (Avenida Paulista, 1313), in a roundtable format, encouraging the active participation of all those present. The meeting will follow the Chatham House Rule, with anonymous recording of contributions.
It will be moderated by Bernard Potsch, FCIArb, Deputy Director of Education at CIARB Brazil Branch, and will feature contributions from Emily C. Westphalen, Karina Goldberg, and Marcela Kohlbach.
The initiative is part of the Branch’s academic agenda, under the chairmanship of Cristina M. Wagner Mastrobuono and the coordination of Lucas V. R. da Costa Mendes and Bernard Potsch.
